This webinar will give you an overview of the new General Conditions of Contract for Construction - National Capital Works 4 (NCW4), released by Austroads and the Australian Procurement and Construction Council (APCC).

The new General Conditions of Contract was developed to improve the efficiency of project delivery and reduce the potential for contractual disputes by driving greater consistency in the contractual conditions and clauses used by members.

NCW4 is intended for use on ‘Construct Only’ contracts awarded by government and semi-government infrastructure agencies. It includes many of the concepts that would be familiar to users of the Australian Standards General Conditions of Contract (such as provision for a Superintendent, Practical Completion, Separable Portions and Defects Liability Periods).

NCW4 adopts contemporary contract drafting practice and addresses legislation such as security of payment, personal property securities, GST and work health and safety. It follows a ‘balanced’ approach to risk allocation in line with the Abrahamson Principles. Development of NCW4 involved extensive consultation with contract administrators/superintendents, consultants and representatives from the construction industry.

Richard Edwards is the former Manager Contracting Operations at the South Australian Department of Planning Transport and Infrastructure. He is a chartered professional engineer with around 40 years of experience in civil engineering, specialising in infrastructure procurement, contract drafting and providing contract management advice. Richard is currently working on the development of new Austroads Technical Specifications.
